DATA PROTECTION
Gardaland and the Merlin Group collect and process the Pass Holder's personal data exclusively for the purpose of providing the Benefit purchased, pursuant to the contract concluded with their Pass Holders. For information regarding the processing of the Pass Holder's personal data, please consult the Privacy Policy published on the Gardaland website, as well as the Privacy Policy published on the Merlin website.
OBLIGATIONS OF THE PASS HOLDER
The Pass Holder undertakes to diligently keep his/her Pass in digital format and to show it to the operators of each Merlin Attraction included in the Benefit, in order to ensure the verification of the Pass itself and the issuance of the free admission ticket.
If you do not show your Pass, as well as your valid identity document, at the individual Attractions, as described above, you will not be allowed to use the Benefit.
In the event of theft, forgetfulness, or loss of the Pass, please refer to the provisions of the Gardaland General Subscription Regulations available on the website fantasypark.shop in the Regulations Section.
RESPONSIBILITIES AND PROHIBITIONS
The Pass and its benefits, including the Benefit governed by these Conditions, are valid only if used by the holder expressly indicated on the Pass itself.
The same Pass and its benefits, therefore, cannot be used by more than one person.
Please note that the Pass (including the specific benefits contained therein) is personal and cannot be transferred to any other person. In the event of irregular or fraudulent use – e.g., transfer to third parties, even if family members – Gardaland and/or the other Merlin Attractions listed above reserve the right to withdraw the Pass and prohibit the Pass holder from accessing the various Attractions for the entire season.
Gardaland and/or the other Merlin Attractions also reserve the right to withdraw the Pass, as well as all the benefits connected to it, in the event of incorrect, harassing, or dangerous behaviour by the holder of the Pass within their facilities. Without prejudice to the provisions of the previous point, Gardaland and/or the other Merlin Attractions reserve, at their sole discretion, the right to deny access to their facilities for subsequent seasons and therefore to deny the possibility of re-subscribing to those who have engaged in or have attempted to engage in fraudulent conduct to the detriment of Gardaland and/or the other Merlin Attractions, as well as dangerous behavior that is not in line with the regulations published on its official websites.
In the event of withdrawal of the Pass, in the event of the occurrence of the episodes described above, it will not be possible for the Season Ticket to proceed again with the purchase of the same admission ticket. In any case, each Pass is verified by the access control system present at the entrance to the Attractions and in the event that, at any time, a subscription in the name of a previously blocked person is detected, or in the event that the customer manages to proceed with the purchase by fraudulently circumventing the booking system, it will not be possible for the latter to use the access ticket, nor request any type of refund.

All figurative and non-figurative trademarks, including the "Gardaland" trademark, as well as the "Merlin" trademarks and the trademarks of the other Attractions, images, illustrations, logos and any other content on the Passes, on the Gardaland website, where these Conditions are published, on the websites of the other Attractions and on the Merlin group website, are the exclusive property of Gardaland, the other Merlin Attractions, the Merlin Group itself and/or the respective owners of the intellectual property rights on the same.
The reproduction, in whole or in part, modification or use of such trademarks, illustrations, images and logos, or any other content, for any reason and by any means, without the express written authorisation of Gardaland, the other Merlin Attractions, the Merlin group itself and/or the respective holders of the intellectual property rights thereto is strictly prohibited.
GENERAL CLAUSES
Partial disability
If one or more provisions of these Terms are declared invalid or ineffective due to a change in the law or following a ruling by a competent court, the other provisions will remain in full force and effect.
Waiver
The fact that one of the Parties does not assert against the other a breach of any of the obligations contained in these Terms shall not be construed as a waiver of the performance of the obligation in question for the future.
Applicable law and jurisdiction
These Terms and Conditions are governed by Italian law. Any dispute relating to the validity, interpretation, execution or termination of these Terms shall be referred to the jurisdiction of the Italian courts with jurisdiction based on the place of residence or domicile of the Pass Holder, if located in Italy, in the absence of a settlement.
Pursuant to art. 141-sexies, paragraph 3 of the Consumer Code, Gardaland informs the Pass Holder, in the event that he has submitted a complaint directly to Gardaland as a result of which it has not been possible to reach an amicable solution, of the possibility of resolving the dispute that has arisen, relating to obligations arising from these Conditions, out of court before the "Alternative Dispute Resolution" body or bodies (ADR entities, as indicated in art. 141-bis et seq. Consumer Code).
The Pass Holder, who is a consumer pursuant to Article 3, paragraph 1, letter a) of the Consumer Code, also has the possibility to resolve any disputes relating to purchases, without recourse to the Court, through the online dispute resolution platform available at the link http://ec.europa.eu/consumers/odr/.
In any case, the Pass Holder's right to bring an action before the competent ordinary courts is reserved, independently of the outcome of the out-of-court settlement procedure for disputes relating to consumer relationships by resorting to the procedures set out in Part V, Title II-bis of the Consumer Code.
A Pass Holder residing in a Member State of the European Union other than Italy may also have access, for any dispute relating to the application, execution and interpretation of these Terms, to the European Small Claims Procedure established by Council Regulation (EC) No. 861/2007 of 11 July 2007, provided that the value of the dispute does not exceed, excluding interest, fees and expenses, Euro 5,000.00. - The Membership Pass (including the benefits contained therein) is personal and non-transferable. The holder must always present the Membership Pass at the entrance to Gardaland Park and Gardaland SEA LIFE; he/she may also be asked to present a valid identity document with a photograph (for children, their health insurance card is accepted).
- The Membership Pass cannot be duplicated in any way; each pass is verified by the access control system at the entrance to the Park. The system recognises and accepts only the personal Membership Pass generated with the holder’s details. Any photocopies or tampering with details printed on the Membership Pass will be recognised and blocked by the system, and prosecuted in accordance with the law.
- Look after your Membership Pass carefully; avoid bending, staining, piercing or exposing it to water, especially around the QR code area. You are obliged to present it in the event of a fiscal control.
- With your Membership Pass, you have direct access to the Park without going through the ticket offices. You must show your Membership Pass whenever you access the carpark area and every time you enter the Park/Aquarium. Besides scanning the Membership Pass, whenever you access the parking area or enter the Park/Aquarium, you may be asked to verify your identity with a valid photo ID. Access to the parking area for motorhomes Access to the parking area for motorhomes can only be booked online in the dedicated section, and is restricted to the number of spaces indicated on this booking; spaces are marked as CAMPER in horizontal yellow signage. Thus, access is guaranteed only as long as the aforementioned area has available specific spaces for campervans/motorhomes. Furthermore, motorhome owners/drivers and passengers are expressly forbidden from disposing of waste and/or sewage at the Gardaland premises (including the parking areas), and from staying overnight, camping or having picnics within the parking area. For more information on access and use of the parking areas, please consult the General Terms and Conditions of Parking.

In the event of the closure of Gardaland Park and/or Gardaland SEA LIFE Aquarium on a date earlier than that indicated above, due to exceptional circumstances beyond our control (for example: fulfilment of orders and requirements of a public authority, legal prohibitions), no refunds and/or extensions of validity will be provided.
- In order to take advantage of the discounts and benefits provided, it is necessary to show the Membership Pass at the specific points of sale before the receipt is issued.

Please note that this discount cannot be combined with other promotions already active at the time of booking.
- In the event of an emergency, follow all instructions issued by staff.
- Only the holder named on the Membership Pass is entitled to use it.
- The Membership Pass (including the benefits contained therein) is personal and not transferable to any other person. In the event of irregular or fraudulent use – allowing it to be used by other people, including family members – Gardaland reserves the right to withdraw the Membership Pass and prevent the holder from accessing the Park and the Aquarium.
- Gardaland has the right to revoke the Membership Pass if it is used by any person other than the holder in whose name it is registered, even if such use has been granted by the purchaser and/or holder temporarily and free of charge; in this event, the purchaser will not be entitled to any refund and/or cancellation of the monthly instalment fee. It is the responsibility of each holder to ensure that the Membership Pass is kept in a safe and secure place and not accessible to third parties.
- Failure to use, theft, loss or other problems for which Gardaland is not liable do not entitle the holder to refunds and/or issue of a duplicate pass. In the event that the Membership Pass is mistakenly left at home, the holder may present in its place a legible photocopy/photograph of the pass (saved on their mobile phone). If no photocopy/photograph of the pass is brought, the holder may access the Park and Aquarium by paying for a daily entrance ticket (10,00 (ten/00) euro per ticket). The price of this ticket will not be refunded. In none of these cases will the holder be able to enjoy the benefits linked to his or her Membership Pass.
- In the event of theft or loss of the Membership Pass, the holder may apply for a replacement by completing the form “Declaration in lieu of affidavit pursuant to article 47 of Italian Presidential Decree of 28 December 2000 no. 445” – this incurs a charge of 20,00 (twenty/00) euro.
- Please remember to always give us prompt notice of any loss and/or theft of your Membership Pass by writing to us at [email protected].
- Holding a Membership Pass does not guarantee admission to Gardaland Park and/or Gardaland SEA LIFE. Gardaland management reserves the right to deny admission for any reason included in the Park rules and regulations, including the Park reaching maximum capacity.
- Any additional events offered during the season may require a supplementary fee.
- Unless otherwise stated, a Membership Pass cannot be used in conjunction with other ongoing offers.
- The Membership Pass can only be used on opening days of Gardaland Park, Gardaland SEA LIFE and of the hotel structures of Gardaland Resort, which can be viewed on the website fantasypark.shop.

The number of attractions each customer can access with the “Time-Saver Pass” benefit is indicated in their “Reserved Area” along with all the benefits provided by their Membership.
Access to each chosen attraction will be possible through the “TIME-SAVER Gardaland Express” walkway.
For the Gardaland Club Membership and/or Gardaland Club Membership Plus holders (purchased from22/11/2023 onwards) the access is allowed up to 3 (three) times a day.
Once the choice of attractions has been confirmed, it may not be changed during the current season, except in exceptional cases checked and agreed in advance with the Park Management and subject to payment of €10,00 (ten/00) for each access already made to the incorrectly selected attraction. The choice of attractions may only be changed, at no extra cost, at the end of the months of November and January of each year.
For more information, please consult the TIME-SAVER PASSES - GARDALAND EXPRESS/SINGLE RIDE regulations.
- With the Gardaland Express/Single Ride, hereinafter also “Time-Saver Pass”, (in addition to the regular admission ticket to the amusement park) you can access to the attractions of Gardaland Park reducing the waiting time in the queue.
- The Gardaland Express/Single Ride is valid only on the day of purchase, unless otherwise indicated, or in the case of an “open-ended” Gardaland Express/Single Ride or in the case of a benefit connected to certain types of Season Pass/Gardaland Club.
- The Time-Saver Pass is strictly personal, non-transferable, non-sellable and non-refundable and, once purchased, it is not possible to modify its type.
- Due to maintenance, power failure, particularly bad weather conditions or operational reasons, one or more attractions may not be available. In all these cases, no refunds and/or extensions of the validity of the purchased Time-Saver Pass will be granted.
- In the event of improper or fraudulent use (for example, transfer of use to third parties, including family members), Gardaland reserves the right at its sole discretion to cancel the Gardaland Express/Single Ride package purchased and to prevent its owner from using it to access attractions with reducedwaiting times . In all such cases, there will be no refunds; the customer can, however, purchase a new Time-Saver Pass.
- Failure to use, theft, loss or deterioration of the purchased Time-Saver Pass or other issues beyond Gardaland’s responsibility will not entitle you to a refund and/or the issuance of a duplicate.
- The Time-Saver Pass can be used only on opening days of Gardaland Park available on the website fantasypark.shop and can be purchased, as well as online, at the dedicated ticket offices and Gardaland Express Points (Medieval, Mammut, West, Jumanji - the Adventure areas). Daily availability is limited.
- To use the Time-Saver Pass, it is strictly essential to use the Gardaland Express application downloadable from the Apple Store and Google Play Store. The link to the stores to download the application is also available on the official Gardaland App. The purchaser is responsible for checking the compatibility of their device with the application.
- Clients with a “Platinum” Season Pass, as well as Gardaland Club Membership and/or Gardaland Club Membership Plus holders (purchased from 22/11/2023 onwards), must access the Gardaland Express app and select the five attractions of their choice for use with the Time-Saver pass throughout the season. Once the choice of attractions has been confirmed, it cannot be changed subsequently. Access to each chosen attraction will be possible through the “TIME-SAVER Gardaland Express” walkway, up to a maximum of three times a day.
- Customers with a "Gold" subscription must access the Gardaland Express app and select the attraction they wish to access with the daily choice included in the benefit. Once the choice of attractions has been confirmed, it cannot be changed at a later date. Access to each chosen attraction will be possible through the “TIME-SAVER Gardaland Express” walkway.
- The choice of attractions, as provided for in points 9 and 10, may not be changed subsequently, except in exceptional cases checked and agreed in advance with the Park Management and subject to payment of €10.00 for each access already made to the incorrectly selected attraction.
- Regardless of the preferential “Time-Saver Pass” held, it is hereby specified that use of the Gardaland Express pass at the various attractions will be subject to availability of existing bookings in the queue reserved to the “TIME-SAVER Gardaland Express”, so as to be able to guarantee an optimal service to the clients at all times. In the event that the aforementioned places are all full, it will be necessary to wait for existing reservations to be admitted so that the actual waiting time in the dedicated queue can fulfil the service promised.
- In case of problems or if you need information and/or assistance, please contact the dedicated ticket offices and Gardaland Express Points (Medieval, Mammut, West, Jumanji - the Adventure areas) within Gardaland Park, or write to [email protected].

It should be noted that Gift Cards cannot be duplicated in any case or way;
Failure to receive such a message may be due to a transient network communication problem or an error by the Customer in the transcription of the e-mail address. In both cases, Gardaland recommends that the Customer contact the Customer Service at the contacts provided at the bottom of these T&Cs.
The sale will be final only when the Order is accepted by Gardaland and it is taken care of by sending the Order confirmation and the e-mail with the Gift Cards to the Customer. Gardaland will be entitled to collect the full price of the Order from the moment the Order is confirmed.

The Gift Card can only be used during the opening season of the park during which it was purchased (including the "Magic Winter" period). In the event that the Gift Cards have already been used, even partially, and/or the withdrawal has not been exercised in accordance with the provisions of the applicable legislation, it will not result in the termination of the contract and, consequently, will not give the right to any refund. Gardaland will notify the Client within 5 (five) working days of receipt of the withdrawal request, rejecting it. In this case, the Gift Cards will remain valid and usable by the Customer at the points of sale within Gardaland and listed above.
Consequences of exercising the right of withdrawal
If the Client exercises the right of withdrawal pursuant to this article, Gardaland will proceed with the refund of the total amount due, without undue delay and in any case no later than 14 (fourteen) calendar days from the date of receipt of the decision to terminate this contract. The refund will be made using the same payment instrument used for the initial transaction, unless the Client has expressly provided otherwise. In any case, the Customer will not incur any expense because of the refund.
In the event of partial withdrawal from multiple orders, the amount of delivery costs to be refunded will be quantified in proportion to the value of the Gift Cards subject to withdrawal.
